Legal Agreement

Terms & Conditions

Last updated: July 5, 2026 • Please read this agreement carefully before booking lessons.

By booking a driving lesson, intensive training course, or test package with Marks Auto Driving, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions outlined below.

1. Licences & Physical Standards

To begin driver training, pupils must hold and present a valid UK provisional driving licence:

  • You must present both your physical licence card and a DVSA check code on or before your first driving lesson.
  • You must satisfy the official eye-sight requirement (reading a standard registration plate at a distance of 20.5 metres, with glasses if necessary).
  • You must notify us immediately of any changes, endorsements, suspensions, or restrictions added to your provisional licence.

2. 48-Hour Cancellation Policy

A strict 48-hour notice policy applies to all scheduled driving lesson adjustments:

  • If you cancel or reschedule a lesson with less than 48 hours notice, you will be liable for the full fee of that scheduled session.
  • Cancellations must be made directly with your assigned instructor via phone call or SMS text message.
  • Your instructor reserves the right to cancel lessons if they feel the road conditions are unsafe (e.g., severe ice, snow, flooding) or due to vehicle breakdown. In these instances, you will not be charged, and the session will be rescheduled.

3. Payments & Block Bookings

Payment terms ensure reliable scheduling and secure slot allocations:

  • Lessons must be paid for in advance via direct bank transfer or online card billing before training commences.
  • Discounted block bookings are non-refundable after training has started, and must be fully completed within 6 months from the date of purchase.
  • We reserve the right to revise our lesson rates periodically. Existing pre-paid block bookings will be honoured at their original purchase rate.

4. Practical Driving Tests

Using our dual-control automatic vehicles for your practical driving test is subject to specific criteria:

  • Test dates must be cleared and agreed upon with your instructor *before* confirming your booking with the DVSA.
  • Your instructor reserves the absolute right to withhold the use of their tuition vehicle for a test if they feel your driving standard is not safe or exam-ready.
  • Test hire packages typically require a minimum booking fee equivalent to 2.5 hours (to cover travel to the test centre, pre-test warm-up, the exam itself, and the return journey).

5. Instructor Legal Status

Your driving instructor is a self-employed Approved Driving Instructor (ADI) operating as an authorized franchise representative of Marks Auto Driving:

Consequently, the training contract is established directly between you (the pupil) and your assigned instructor. Payments made directly to instructors, scheduling disputes, or vehicle-related questions are under the direct jurisdiction of your instructor.

6. Safety, Fitness & Conduct

We prioritize road safety above all else. Your training is subject to the following rules:

  • You must not be under the influence of alcohol, prescription drugs, or illegal substances that impair alert state during training. If your instructor suspects impairment, the lesson will be terminated immediately, and you will be charged in full.
  • Pupils must behave respectfully. Aggressive, abusive, or dangerous behavior inside the vehicle will result in the immediate termination of the lesson.
